Exclusion of Warranties and Limitation of Liability: Except as expressly provided for in this agreement and subject to any laws, in your jurisdiction, that could prohibit or limit, in whole or in part, the scope of the present exclusion of warranties and limitation of liability, JNH Lifestyles, its affiliates, their directors, administrators, employees, agents, independent content suppliers, special partners, mandatary suppliers of license and other persons with whom JNH Lifestyles is bound or has a business relationship with (collectively the "beneficiaries") does not make or give any representation, warranty or condition of any kind, whether express or implied, statutory or otherwise, including without limitation, warranties as to uninterrupted or error free transactions, privacy, security, merchantability, quality, title, durability, suitability, non-infringement or fitness for a particular purposes, or those arising out of a course of dealing or usage of trade.
In no event will JNH Lifestyles and its beneficiaries be liable for any indirect, incidental or consequential damages, howsoever caused, including but not limited to, any lost profits, lost savings, loss of use or lack of availability of facilities including computer resources, routers and stored data, punitive, exemplary, aggravated or economic damages, arising out of the products provided by JNH Lifestyles or otherwise related to this agreement or the transactions conducted on or from the www. Jnh lifestyles.Com website, even if JNH Lifestyles or any of its beneficiaries have been advised of the possibility of such damages or claim. In no case will its beneficiaries' total liability arising under any cause whatsoever (including, without limitation, breach of contract, negligence, gross negligence or otherwise) be for more than the amount paid by you for the specific products ordered under this agreement and to which the claim relates. In no event will JNH Lifestyles or its beneficiaries be liable to you for damages or losses resulting from viruses, data corruption, failed messages, damages arising as a result of: transmission errors or problems, telecommunications service providers, JNH Lifestyles contractors, the internet backbone, third-party suppliers of products or services, damages or losses caused by you, or your respective employees, agents, mandataries or subcontractors, or other events beyond the reasonable control of JNH Lifestyles. You agree to defend and hold harmless JNH Lifestyles and its affiliates against all claims, losses or damages of any kind whatsoever resulting from or caused by a breach of the foregoing and your use of the present website, including any claim for intellectual property infringement. Order Processing: Orders received before 6:00 p.m. U.S. Pacific Standard Time are typically shipped in 3-5 business days. Processing can potentially take longer than the provided estimated times, depending upon order volume and seasonality. If determined that the shipment and processing period will extend beyond a 7 business day time frame, we will attempt to notify you. Regarding Address Changes: Addresses normally cannot be changed unless it is absolutely necessary. If an address change is required, you will be subject to a minimum of a $35.00+ fee. This fee is automatically charged for any type of address change by the third-party shipping companies that delivery your JNH Lifestyles products, regardless of the circumstances. If you should need to change an address, please email customer service at support@jnhlifestyles.com. You will then be notified of the final fee amount. When placing your order, please confirm that the address has been entered correctly before submitting to avoid potential fees.
Shipping: A minimum of $99.00 to $499.00 shipping fee applies to all orders (residential & commercial) within the contiguous United States at the time of purchase. The state provided in the shipping address and the shipping tier selected at checkout will determine the cost of shipping. For specific pricing, please refer to our Shipping & Returns page. Express Freight orders will be prioritized and generally arrive within 8 to 12 business days. Depending on order volume and seasonality, this time frame may be exceeded. Express Freight is a non-refundable fee. Note: This is not a guaranteed express service. Standard Ground shipments generally arrive within 15 to 20 business days. Depending on order volume and seasonality, this time frame may be exceeded. Standard Ground is a non-refundable fee. International ground shipments are generally expected to arrive an additional 1-2 week based on clearance requirements by customs. Shipments to countries outside of the U.S. may be subject to taxes, and customs duties and fees collected by the destination country ("Import Fees"). THE SHIPMENT RECIPIENT AS IMPORTER IS RESPONSIBLE FOR ALL IMPORT FEES LEVIED BY THE DESTINATION COUNTRY.
Delivery: Delivery inside a residence is not available for most addresses. Professional Delivery & Assembly Services is an in-home delivery option that will be presented at checkout to qualifying shipping addresses for an additional fee. If you are not presented with Professional Delivery & Assembly Service at checkout after entering a shipping address, you do not qualify. For more details, please refer to our Shipping & Returns page. Standard LTL Shipping (Residential Delivery) brings the freight truck to the most convenient curbside delivery location for the driver. Residential Delivery will not deliver to a loading dock and does not include a liftgate service. If liftgate is required, there will be an additional fee. The amount of a liftgate service fee varies by location and availability. Ask your sales representative for more information. Residential Delivery cannot be guaranteed under any circumstances, and is a non-refundable fee.
Damage during Shipment: Your item(s) undergo a thorough manufacturer's inspection prior to shipping and are insured for damage that may happen during shipment. IMPORTANT: Please be advise that it is your responsibility to report any damage or loss that may occur during shipment. If you receive a damaged product, do not accept the package and contact the shipper to file a damage claim. As mentioned earlier, items are insured for damage that may occur during shipment, which is meant to provide you with the funds to repair the damage or loss. The amount the item is insured for is approximately the wholesale cost of the item minus shipping. JNH Lifestyles cannot take responsibility for damage or loss during shipment. If you choose to refuse your shipment, the total claims process can take 4 to 12 months; on occasion the claim can even exceed this time frame.
Order Cancellation Policy: Orders normally cannot be cancelled. Any cancellation to an order after the original sale date will automatically incur a 20% restocking/cancellation fee, plus any international shipping charges incurred. Please call ahead of time before canceling. If wish to cancel, but the order has already been shipped, you will be responsible for all of the freight costs. This includes the cost to ship your item(s) back to the manufacturer. If the unit you originally purchased goes out of stock during the processing of your order, we will replace the unit with an item of equal or greater value. Stock status cannot be used as a reason for an order cancellation.
Return Policy: A Buyer may cancel and return purchased item(s) to JNH Lifestyles (Seller), subject to the terms and conditions of this policy, by providing a written notice to the Seller within thirty (30) days of Buyer's receipt of the Goods. Not applicable to custom models, closeout models, sauna accessories and spa products. EXCEPT AS EXPRESSLY PROVIDED HEREIN, CUSTOM ORDERS MAY NOT BE CANCELLED OR RETURNED TO SELLER. DEPOSITS NOR PAYMENTS MADE BY BUYER TO SELLER FOR CUSTOM ORDERS WILL BE REFUNDED. BUYER IS FULLY LIABLE FOR PAYMENT OF THE CUSTOM ORDER. “Custom order” is defined as any order from a Buyer that is designed or manufactured entirely or partially under Buyer's specifications. In the event the Buyer elects to cancel a non-custom order, Buyer shall assume all risk of loss, including return, shipping, handling, restocking and other fees, costs and expenses as described in this policy and any others associated. Seller reserves the right to refuse to refund any deposit or payment or cancel any payment due and owing until Seller (a) is in receipt of the Goods; (b) performed inspection of Goods; and, (c) per Seller's discretion, has found Goods to be damage free. RETURNED GOODS MUST BE IN THEIR ORIGINAL PACKAGING. In addition, Seller reserves the right to refuse partial or entire deposit refund or payment or cancel any payment due and owing if the Buyer fails to comply with or violates the terms and conditions of this policy. Cancelled and returned Goods are subject to: (a) storage fees and costs associated with re-routing (b) handling and restocking fees (c) shipping costs to and from Seller and, (d) Seller providing Buyer with a Return Merchandise Authorization (“RMA”) number. Buyer’s failure to provide RMA number upon return shall result in Seller not accepting any shipment and Buyer paying all Cost and Fees. Costs and Fees as determined by Seller shall be paid by Buyer to Seller upon Seller’s request.
Manufacturer's Defects/Warranty: Seller confirmed manufacturer's defects in an item you purchase will be fixed or newly replaced. We generally warrant the products to be free of material defects in workmanship for at least a period of One (1) year from the date of purchase. However, under warranty, parts will be free of charge if they need to be replaced and sent via Standard shipment with zero cost to the Buyer. Express shipment encompasses additional charges and are the Buyer’s responsibility to pay upon service request. If a part is lost during shipping, you have the choice to file a shipping claim or to reorder under personal cost.
